Who has to arrange an asbestos inspection?

Regulation 4 of the Control of Asbestos Regulations 2012 is the duty to manage asbestos in non-domestic premises. It falls on whoever is responsible for maintenance and repair, by contract or tenancy, or on whoever controls the building.

Buildings the duty covers

  • Offices, shops, factories, warehouses. The owner, the tenant, or both, depending on the lease.
  • Common parts of blocks of flats. Halls, stairs, lift shafts, risers, roof spaces, boiler rooms, garages.
  • Schools, churches, halls, surgeries. Whoever is responsible for maintaining the building.

A managing agent can carry out the tasks, but the duty itself stays with the dutyholder.

Rented homes and your own home

Regulation 4 stops at the front door of a rented house or flat, but landlords keep general duties under the Health and Safety at Work Act. In your own home there’s no duty to manage, but anyone employing people to work on it must still check first. A survey of the rooms before repairs or a refit means contractors know what’s there.
